Q: I am a man who proposed a girl for my son, and her father and the girl both accepted. An agreement was reached regarding the bridal gift and all the conditions, and their marriage contract was concluded. After a period of time, our village and a neighboring village agreed to set a limit on bridal gifts, and they decided on its form and conditions at a lower amount than what I and my relatives had agreed upon. Since I contracted the marriage for my son to his fiancée before this agreement, and since the people of the village want me not to deviate from their agreement, and out of my concern not to violate any of the conditions of the marriage contract for fear of it becoming invalid, please rule for us, may Allah reward you with good: should I proceed according to the terms of the marriage contract or according to the agreement of the people of the two villages? Knowing that the agreement of the two villages
stipulates taking an oath from the guardian of the groom and the bride as well.
A: If the situation is as described, the groom must adhere to the conditions of the lawful marriage contract; in compliance with the saying of the Exalted and Majestic:[Al-Ma'idah 5:1] and His saying (peace and blessings be upon him): And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
