Fatwa No. ( 11300 )
Q: I am informing you that I am one of the young Saudi men, and I proposed to a girl from my tribe. At that time, I was a university student, and I paid part of the mahr, which was agreed upon by the tribe members to be fifty thousand riyals (50,000). However, the circumstances of my studies forced me to delay the marriage. It happened that my fiancée’s brother proposed to us and asked for the hand of my sister in marriage with a mahr of fifty thousand. This was three years after I had contracted the marriage with his sister. When I graduated from university, I asked my wife’s family to set a date for the wedding, but they insisted that my wedding with their daughter and my son-in-law’s wedding with my sister take place on the same day, knowing that I had paid them the full mahr, and their son had paid my family the full mahr for my sister. Do you see,
Your Eminence, that this is in any way shighar, or is it a valid marriage with nothing wrong with it? Knowing that no condition was included in the marriage contracts between the spouses.
A: If your marriage to the aforementioned girl and her brother’s marriage to your sister were without any condition between you and there was no collusion to marry each other’s relatives, then the marriage is valid if its pillars and conditions are met and its impediments are absent. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
