Q5: Regarding the conditions of the marriage contract: Does concealing worldly circumstances (a previous marriage and children) in the suitor from the guardian affect the conditions of the contract, if the prospective bride was aware of this and agreed to his religion, worldly affairs, and character?
A5: If the prospective bride was aware of her suitor's worldly circumstances, such as having been married before and divorced, or his wife having died, or her still being
remaining under his protection, and such as having children, and she accepted him as a husband due to his uprightness in his religion, character, and worldly affairs, and she concealed this from her guardian just as the suitor concealed it from him, fearing that he would object to her marriage to him, then if the reality is as described, her concealing this does not affect the marriage contract, nor does it invalidate it, as long as the guardian is the one who handled it, with her consent to this marriage; due to the presence of compatibility in religion, and because the right in such matters as were concealed belongs to her, not to her guardian. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
