A. - He says in it: I work as a marriage officer, and I have heard from some of those who claim to be scholars: that the marriage contract for two spouses, one of whom does not pray, is invalid, and it is not permissible to contract the marriage for them. Is this correct? And what should I do if I am asked to contract a marriage? Should I ask about the condition of the spouses regarding their prayer? Or should I contract the marriage without asking? Please give us a ruling, and may you be rewarded.
A: In the name of Allah, and all praise is due to Allah. If you know that one of the spouses does not pray, do not contract the marriage for him to the other; because abandoning the prayer is disbelief; due to the saying of the Prophet (peace and blessings be upon him):Sahih Muslim 82b which Muslim recorded in his Sahih, and the saying of the Prophet (peace and blessings be upon him): Sunan Ibn Majah 1079Sahih (Darussalam) which Imam Ahmad and the people of the four Sunan collections recorded with a sound chain of narration.
We ask Allah to rectify the conditions of the Muslims, and to guide their strays, for He is the All-Hearing, the Near.
