Q1: A man died, leaving behind three sons and five daughters from a car accident, and his father is still alive. Do the children of the deceased man have the right to claim inheritance from their uncles after their grandfather’s death?
A1: The children of this man who died before his father do not have the right to claim a share of the inheritance from their uncles, to be shared with them, from what their grandfather owned at the time of his death, even if some or all of it had come to their grandfather by inheritance from their father; because they are blocked from inheriting from their grandfather by their uncles; due to the saying of the Prophet (peace and blessings be upon him):Sahih al-Bukhari 6737 , and if their father had earnings that he brought to their grandfather, then they are in their right to claim them.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
