Q: If we are brothers, and some of us are educated while others are not, does our inheritance differ? Because some of us were educated and others were not, or some of us had their children raised in the family home while others did not.
A: The inheritance of male brothers, if they are equal in their closeness to the deceased and in the strength of their claim, such that they are all full brothers or paternal brothers, and the deceased was their brother, then their inheritance is equal, meaning that each one’s share is like the other’s. It does not affect the inheritance that some of them are educated or that they raised their children in the family home. Likewise, if they are brothers but are the children of the deceased, they are equal in inheritance. If they are males and females, the male receives the share of two females.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
