Fatwa No. ( 1342 )
Q: Is it permissible for a person to disinherit one of his sons and give his share to the other?
A: It is not permissible for a person to disinherit one of his sons and give his share to the other; because a son is entitled to his father's inheritance upon his father's death by virtue of kinship, and this is a ruling from Allah (Mighty and Majestic). The father does not have the authority to waive this right, so he may not dispose of it except within the limits prescribed by Allah. Allah has not prescribed for a father to disinherit his son and give his share to the other. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
