Fatwa No. ( 17855 )
Q: I was a Christian, and my father passed away on 10/3/1992 CE, and I was 24 years old at the time. I had four brothers and three sisters. An inheritance from my father was allotted to me, divided through the Shari'ah court, consisting of: 1 - A portion of a two-story house built on an area of 8 qasabat. 2 - A sum of money amounting to 1,211,011 Egyptian pounds, in the form of investment certificates that belonged to my father, and this was my share of them. Then I relinquished the money from the bank to my mother, knowing that this amount could not be withdrawn from the bank until 1996 CE. Then Allah granted me the favor of Islam on 24/3/1994 CE. Due to my urgent need for money, I revoked the relinquishment I had made to my mother previously, as I had borrowed a similar amount until it could be withdrawn from the bank. This is after my increased knowledge of the rulings of Islam, I seek your ruling on the following: Do I have the right now to what was allotted to me from my father's inheritance before my conversion to Islam? If so, do I have the right to revoke the relinquishment I had previously made to my mother before
my conversion to Islam and which I revoked after my conversion to Islam? Please inform us, may Allah reward you, and may Allah reward you with good.
A: First: Praise be to Allah who has granted you the favor of Islam, and we ask Him (Glorified and Exalted is He) to keep us and you firm upon it and to cause us to die upon it as Muslims. Second: As for the inheritance you inherited from your father while you were both on the Christian religion at that time, it is a valid inheritance, and Islam does not prevent you from taking it and possessing it. Third: As for your relinquishment of the aforementioned money to your mother and then your revocation of this relinquishment before your mother took possession of it - it is better for you to continue with this relinquishment and not revoke it; because that is a matter of excellence toward your mother, and Allah the Exalted said regarding the parents:[Luqman 31:15] , and when Asma' asked the Messenger of Allah (peace and blessings be upon him): . However, if your mother had taken possession of the money, it is not permissible for you to take it back.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
