Q: My husband has passed away, and I am his only heir. I wish to make a bequest from his estate and from the wealth I inherited from him. What is the ruling on this?
A: Of what the man left behind, you are entitled to only one-quarter as an obligatory share. What remains after the one-quarter belongs to his residuary heirs. If he has no residuary heirs, the matter is referred to the Shari'ah court. You are not permitted to make a bequest except from your own personal wealth, and only up to one-third or less. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
