The questioner : Is it permissible for me to reside with my mother, even though she is under the guardianship of another man and in a house other than my father's, which is far from me, given that her husband has left her while she is still under his guardianship? And is it permissible for me to get married in her house, even though the house belongs to her? And should I leave my father's house, which belongs to me, even though my father has been deceased for several years? She is the one who asked me and my younger brother to accept her request. Should we refuse, and what is the ruling on this?

The Shaykh : There is no blame on you or your brother to reside with your mother as long as the house is hers, because she is its owner, and the owner of a property is the owner of its benefit. So, if she has asked you both to reside with her after marriage, there is no blame on you both to reside with her. As for the house that your father left behind and which has become your property, you can make use of it by renting it out, and you can benefit from its rent to meet the exigencies of life.
