Q1: I performed ghusl (the full ritual bath) at the miqat (boundary) for entering ihram (the consecrated state of pilgrimage) during last Ramadan. I forgot to perform wudu' (the ablution for prayer) after the ghusl, and I prayed at the miqat and performed tawaf (circumambulation of the Ka'bah) with that ghusl. I also prayed Zuhr (the midday prayer) with it. After I remembered this while I was still in the same Haram (sacred precinct), I looked for a mufti (a scholar who issues fatwas) but found no one at that time. One of the soldiers said there was a man who would give me a ruling, so I went to him and asked about my tawaf and prayer with that ghusl without wudu'. He told me that my prayer and tawaf were valid. What is the correct ruling in this matter? If my ghusl does not suffice for wudu', what should I do about my Zuhr prayer and my tawaf, and is my 'Umrah (the lesser pilgrimage) valid?
A1: The aforementioned fatwa is incorrect, and you remain in a state of ihram for the 'Umrah; if you have not returned to perform tawaf while in a state of purity, it is obligatory for you to
proceed to Makkah in a state of ihram as soon as possible, and perform tawaf around the House and sa'y (walking between al-Safa and al-Marwah), then shave or shorten your hair, and thereby your 'Umrah will be completed. However, if you had sexual intercourse with your wife after the aforementioned tawaf and sa'y, then the 'Umrah is defective, and you must make it up as we mentioned, and then perform another 'Umrah in its place from the miqat from which you entered ihram for the first one. It is also obligatory for you to slaughter a sheep in Makkah and distribute it among its poor people if you had sexual intercourse after the tawaf and sa'y that you performed while you thought you were in a state of purity. It is also obligatory for you to make up the Zuhr prayer with four rak'ahs (units of prayer), along with repentance and seeking forgiveness for your negligence in not taking care to ask the well-known scholars of knowledge in the al-Masjid al-Haram (the Sacred Mosque) . And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
