Q: A pilgrim committed a prohibited act: he kissed his wife and ejaculated outside the vagina with desire after stoning the Jamarat al-Aqabah and shaving his head, but before the Tawaf al-Ifadah. His wife is not a pilgrim. Please give us a ruling, may Allah reward you.
A: It is not permissible for a Muslim who has entered the state of ihram for Hajj, 'Umrah, or both to expose himself to anything that would invalidate his ihram or diminish his worship. Kissing is forbidden for one who has entered ihram for Hajj until he performs the complete release from ihram, which is by stoning the Jamarat al-Aqabah, shaving or shortening the hair, and performing the Tawaf al-Ifadah and Sa'y if Sa'y is required of him; because he remains under the ruling of ihram, in which women are forbidden to him. The Hajj of one who kisses his wife and ejaculates after the first release from ihram is not invalidated. He must seek forgiveness from Allah and not return to such an act. He must make up for this by slaughtering a head of livestock that is acceptable as an 'Id sacrifice, and distributing it to the poor of the Makkah Haram. It is obligatory to hasten to do this as much as possible. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
