Q1: A person came to us wishing to have his father's bequest certified by a legal document, as it was written on a plain piece of paper. This bequest stated: that he would give his sons who had not yet married twenty thousand riyals from his estate; to help them with their marriages, in line with their brothers who had already married, as he had helped them with a similar amount. We hope you will inform us, may Allah preserve you: Is this bequest valid, even though it is a bequest to an heir, or is it not valid if the heirs do not approve of it? May Allah preserve you and protect you, and may He grant you abundant reward and recompense. And peace be upon you, and Allah's mercy and blessings.
A1: There is no objection to executing the bequest if the sons who were bequeathed to had reached the age of marriage before their father's death, and it is to be taken from the principal capital, in consideration of fairness between them and their brothers who were married for them. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
