Justice Among Children and the Ruling on Executing a Bequest for One of the Children
Machine translationRead the Arabic original
His Eminence the Shaykh: Is it obligatory that if you buy something for one of your children, you give the other the same? Likewise, a man bequeathed that a car be bought for his son after his death; is this bequest executed?
As for the first, which is giving during one's lifetime, it is obligatory to be just among the children, [Surat al-Nisa: 11] This is if the giving is a voluntary gift. However, if the giving is to meet a need, then one gives each person what he needs. For example: If he has two sons: one is studying, so he needs books, pens, ink, and other things, he gives to him and does not give to the other who is not studying.
If one of them needs treatment, he treats him, and does not give the other what he spent on this son's medicine and treatment.
Likewise with daughters, a woman needs jewelry for her ears, neck, and head, and a son does not need such things, so you buy for the daughter and do not buy for the son these things regarding maintenance.
Likewise: If one of the children needs to get married, you marry him, and the other is young and has not reached the age of marriage, so you do not give to him.
And as for the bequest after death, it is absolutely forbidden;Because the Prophet (peace and blessings be upon him) said: (There is no bequest for an heir).
As for the first, which is giving during one's lifetime, it is obligatory to be just among the children,
for the male, what is equal to the share of two females
لِلذَّكَرِ مِثْلُ حَظِّ الْأُنْثَيَيْنِIf one of them needs treatment, he treats him, and does not give the other what he spent on this son's medicine and treatment.
