Q: There is a woman who has a husband and a guardian, and she is pregnant, and the pregnancy in her womb harmed her until the fetus died in her womb. So she made a bequest that when she is placed in her grave, they should cut open her belly and extract the child from her womb, and in fact they cut open her belly and took out the child dead from her womb. They found it deformed in shape, large in size, with long hair above its shoulders, and they buried it as it was next to her. This case was five years ago, and since there are no roads leading to the town where there are hospitals, and they are at the top of a mountain called: Al-'Ali Banu Malik, and they have regretted what they did and the execution of the aforementioned woman's bequest, what is required of us in this matter? Please inform us, may you be rewarded with good.
A: It was not befitting for the aforementioned people to execute this bequest, even if she had bequeathed it; because it is a bequest to mutilate a corpse, and that is forbidden, and they must
repent to Allah and seek His forgiveness for that act. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
