Q: First: Our father, may Allah have mercy on him, established a mosque a long time ago and left a will that his sons after him should take care of the mosque, its repair, its maintenance, its sanctuary, and all its necessities, and that the five daily prayers be held in it. Due to the age of the aforementioned mosque and the large number of worshippers in it at present, there has been a shortage of space. We, his sons, have decided to demolish the aforementioned mosque to expand it and build it anew in the modern style, and out of our desire
to expand the mosque by a large area; we have decided to build a lower floor consisting of shops on the side facing the main street for the benefit and interest of the aforementioned mosque, and on the other southern side to build two residences for the imam and the mu'adhdhin and the minaret, and on the northern side to build two ablution areas and a water tank, and for the mosque to be above the ground floor, i.e., above the shops and the residences; because the area will be larger due to the presence of verandas on three sides, and the mosque will be above the aforementioned shops, away from the noise and disturbance present in the surrounding streets, and the ascent to it will be easy and convenient via modern, short, comfortable stairs that do not exceed ten steps, as the ascent to the aforementioned mosque is very easy and convenient. On this basis, two benefits are obtained: The first: adding a large area to expand the mosque, which is the roofs of the shops; because they will be level with the floor of the mosque, in addition to the verandas. The second: the existence of a fixed and permanent income to be spent on the mosque and its interests and its security with an imam, a mu'adhdhin, and a guard for years to come, if Allah wills, and all that is required for it now and in the future, and this will be a continuing good deed for the benefit of the mosque and a guarantee that it will not be neglected by those in charge of it from generation
to generation, and all of this is for the sake of the face of Allah the Exalted, and we ask Him for more success, help, and rectitude. We ask you, Your Eminence, and the members of your esteemed administration, for a fatwa regarding the construction of the aforementioned mosque and its benefits in the manner we have explained above.

A: It is permissible to demolish the aforementioned mosque and rebuild it in the manner you mentioned in the question; because there are many benefits for the mosque in this, including providing nearby housing for both the imam and the mu'adhdhin, facilitating ritual purity for those who visit the mosque for prayer, expanding it to accommodate a larger number of worshippers, and generating income from the shops to spend on its repair and maintenance, and paying salaries to the imam, the mu'adhdhin, and the other employees of the mosque. It has been established with the Committee that these benefits are present in the aforementioned procedure. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
