Q: We present to your magnificence that Ibn Razyan Mosque was previously expropriated to widen the Al-Furyan Street in Riyadh, and compensation was assessed for it by the municipality and allocated in the Monetary Agency, but it has not yet been delivered to this ministry. The esteemed Shaykh, Abd al-Rahman ibn Faris, has generously volunteered to build a replacement mosque on the main street, which is only ten meters from the site of the former mosque. This ministry then took possession of it, furnished it, carpeted it, and installed air conditioning from the relevant budget line of this ministry, as its compensation is still held by the Riyadh Municipality. Since there are two endowments on this mosque for the residence of the imam and the mu'adhdhin, built of mud brick and clay, the esteemed Shaykh, Abd al-Rahman ibn Faris, wrote to me in a letter dated 10/11/1405 AH, in which he suggests demolishing them and rebuilding them.

He mentioned, may Allah reward him with the best reward, that if the funds are insufficient, Allah will facilitate someone to complete them... and so on. Therefore, I ask your Excellency to review this and state your opinion from the Sharia perspective on the permissibility of building the residences for the imam and the mu'adhdhin from the amount allocated for the original mosque, especially since it has been facilitated for someone to build the replacement mosque after the state provided the replacement land for the mosque land, and only the value to compensate for the construction remains.

A: If the matter is as described, it is permissible to build the two houses designated as residences for the imam and mu'adhdhin of Ibn Razyan Mosque in Riyadh from the value assessed for the original mosque, land and building, since the municipality has delivered land on which the new mosque is to be built in place of the land of the old mosque, and some benefactors have undertaken the construction of the new mosque, and the funds requested for the construction of the two houses are the value of the ruins of the old mosque, and the construction of the two houses attached to the mosque is part of the mosque's interest. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
