Spending the remainder of the produce in channels of charity after repairing the one-third share and fixing it

Fatwa No. ( 8910 )
Q: One of my relatives, Muhammad ibn 'Abd al-Wahhab al-Hudlaq, has passed away to the mercy of Allah, leaving behind three daughters and a wife. The deceased owned a one-third share, and the income from this one-third exceeds the cost of the sacrificial animals and reasonable charitable works mentioned in his will. I seek your ruling, Your Eminence: Do the daughters and their mother have a right to the income from the one-third share, given that two of the daughters are married and one is divorced and living with her mother in a house belonging to the three daughters and their mother without payment? As for the two married daughters, they are provided for by their husbands in terms of housing, food, and clothing, but as for anything else, they may have needs due to the requirements of life at the present time, so we ask your Eminence to issue a ruling for us
may Allah reward you for that, and to mention the percentage that is given to the daughters and their mother if they have a right to something?
A: After repairing the one-third share and fixing it from the produce, what he willed regarding the sacrificial animals is carried out. If anything remains of the produce, it is spent in channels of charity and gates of good for him and his parents, and it does not return as inheritance. If any of his daughters or other heirs is wealthy, he has no right to the income from his one-third share. If any of them is poor, he is given from its income due to his poverty and need. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
