The first question of Fatwa No. ( 16658 )
Q1: We have a farm endowed for the village mosque, and next to it is a farm belonging to one of the residents that he donated to be used as a cemetery. Is it permissible to annex the endowed farm to that cemetery?
A1: The endowment must remain as it is, and its proceeds must be directed to the party specified by the endower. If the benefits of the endowment are suspended, or if the designated recipient specified by the endower no longer exists, then it is obligatory to refer the matter to the judge for consideration. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
