Fatwa No. ( 3912 )
Q: I am inquiring of your eminence that I am a widow with no husband, advanced in age, and I have a house on Abu Dharr Street which I live in and own. I have bequeathed one-third of my wealth and my estate after my death, and the two-thirds remain. I wish to endow half of the house for students of knowledge at the Prophet’s Mosque, and the three quarters remain for the heir, who is my nephew. I have no other heir besides him. But, alas, my aforementioned nephew has cut off family ties; he does not visit me in person, nor does he speak to me by letter. He comes to Madinah but does not visit me, neither in my health nor in my illness, for many long years. What is your opinion
O you people of virtue?

A: It is permissible for you to endow your entire house or part of it as long as you are healthy and wealthy, fearing poverty and hoping for wealth, with the note that a completed endowment cannot be revoked by the endower. You may also bequeath from your wealth what you have not endowed in whatever avenues of righteousness you wish, provided that this is within the limit of one-third or less. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
