Q: A group of people come to me to buy a car, or two, or three, for example, for a known amount of money. The buyer pays the value of the car or cars, takes possession of the cars, and operates and moves them from their place while they are still inside the showroom. Then the buyer sells the car or cars he bought from me to another person on credit. The buyer takes possession of the cars and moves them from their place, then offers them for sale to me, the owner of the showroom, or to other people. Is it permissible for me to buy them from him or not? What is the correct method? Please inform me, may Allah reward you with good, in a letter to my address so that I can know the right from the wrong. Know that this method, I mean the buying and selling, is common in all car showrooms. May Allah bless you.
A: If the first buyer takes possession of the car and holds it, then sells it on credit to another person who takes possession of it, then if the second buyer wants to sell it to the first seller or to someone else, there is no harm in that. As for moving the car inside the showroom, this is not considered possession. Therefore, the sale is not valid because it occurred before taking possession of the car.
