Q: I am a man who trades in selling cars on monthly installments, and this matter has begun to worry me greatly because of the fatwas I hear and read on this issue. First: the method by which I buy the car that I then sell on monthly installments. I first inspect the car and look at it before buying it, and then I pay the value of the car, which is approximately (35) thirty-five thousand, and I receive a receipt for the value, type, and model of the car, and it is in its place in the showroom, since it is not
established for me that I own the car except through this receipt, and this is my method for buying any car, and since I buy the car with the desire to increase the price through installments. Second: the method by which I sell the car on monthly installments. The buyer comes and negotiates with me to buy the car, and we agree on an amount, for example (50,000) fifty thousand riyals, and the monthly installment is, for example, (1,500) one thousand five hundred riyals, limited by the number of months and limited by its total value. I sell some cars with a down payment and others without a down payment, depending on the agreement between me and the buyer. I know that the buyer does not need the car itself, but his need is for the value; after he buys the car, he sells it to another buyer for cash at a price lower than the installment price due to his need for money, without any relationship of mine to the new sale. I ask your Eminence to clarify whether this sale and purchase is valid or not permissible? And if it is not permissible, what is the ruling on the previous sales and purchases? Please inform us, may Allah have mercy on us and on you.
A: If you buy a car or anything else, it is not permissible for you to sell it until you take possession of it completely by moving it from the seller's place to your own place; because the Prophet (peace and blessings be upon him)
prohibited the sale of goods where they are bought until the merchants take them to their homes. As for the buyer buying the car from you when he does not need it, but rather wants to sell it because he needs its price, you have no relation to that, and there is no blame on you if you do not buy it from him. This is called the issue of (tawarruq), and it is permissible according to the majority. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his companions.
