Fixing the Intention for Fasting

Machine translationRead the Arabic original
The first question of Fatwa No. ( 4352 )
Q1: Does the intention for fasting Ramadan have to be made at night, or during the day, as in the case where you are told at the time of the forenoon prayer that this day is from Ramadan, should you make it up or not?
A1: It is obligatory to fix the intention for fasting the month of Ramadan at night before the dawn, and it is not permissible to begin the intention for its fast during the day. So, if one learns at the time of the forenoon prayer that this day is from Ramadan and he intends to fast, he must abstain until sunset, and he has to make up the day; for what was narrated by Ibn 'Umar from Hafsa (may Allah be pleased with them) from the Prophet (peace and blessings be upon him) that he said:
Whoever did not decide to fast before Fajr then there is no fast for him.من لم يجمع الصيام قبل الفجر فلا صيام له
Jami` at-Tirmidhi 730Da'if (Darussalam)
It was narrated by the Imam Ahmad and the authors of the Sunan and Ibn Khuzaymah and Ibn Hibban , and they authenticated it as marfu'. This is regarding the obligatory fast. As for the voluntary fast, it is permissible to make the intention for it during the day if he has not eaten, drunk, or had intercourse after the dawn; for it is established from the Prophet (peace and blessings be upon him) in the hadith of 'A'ishah (may Allah be pleased with her) that he entered upon her one day
in the forenoon and said:
Do you have anything? She said: No. He said: Then I am fasting.هل عندكم شيء؟ فقالت: لا، فقال: إني إذًا صائم
It was narrated by Muslim in his Sahih. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
