Fatwa No. ( 5012 )
Q: The amounts and items detailed in the statement were found missing from the student housing in al-Dar'iyyah for a long period, namely: 1 - An amount of 496, that is, four hundred and ninety-six Saudi Riyals. 2 - An amount of 25, that is, twenty-five Yemeni Riyals. 3 - A number of 7, that is, seven wristwatches of different types. 4 - A number of 3, that is, three small calculators of different types, two of which are scientific. 5 - A number of 3, that is, three pairs of glasses of different types. 6 - A number of (1), that is, one open-front sweater. We informed the housing administration that despite the announcement of these amounts and items at the time, and their remaining with the housing for a long period, some of it from last year 1400/1401 AH, their owners did not come to collect them; therefore, the physical items mentioned above were sold at auction for an amount of (1150), that is, one thousand one hundred and fifty Riyals, in addition to the cash amount, making the total in cash (1646), that is, one thousand six hundred and forty-six Saudi Riyals and (25), that is, twenty-five Yemeni Riyals, and the housing administration has provided us with this amount along with a copy of the sale record.
The items referred to in the auction, and they request that this amount be deposited into the student fund account, from which expenses are made for various forms of care, assistance, and charity for needy students. It is of great concern to us that you issue a fatwa on this matter, and whether there is any issue with depositing this amount into the student fund account so that we can act in light of your fatwa, Your Eminence? And while we fully appreciate your responsibilities—may Allah assist you in bearing them—and your many engagements, we look forward to receiving your fatwa soon, given the approaching end of the current academic year. We ask Allah to preserve you, bless you and your knowledge, and make it beneficial, and to reward you for us, for Islam, and for the Muslims with good.
A: If the situation is as described, it is permissible to spend the amount on charitable causes, including depositing it into the student fund account, from which expenses are made for various forms of care, assistance, and charity for needy students. However, if someone who has a right to these amounts becomes aware of it later, they should be informed of the disposal that has taken place. If they are satisfied with it, that is fine; if they claim their right, it should be paid to them from this fund account or from another source.
