Q: I am an elderly man, approximately eighty years old, with no specific income. I have two wives, praise be to Allah. One lives in the Tabuk region, and the other lives in the Al-Ula province, which is part of the Madinah al-Munawwarah region. With Allah’s help, I purchased a residential plot of land with my personal funds for my wife who lives in Tabuk . I applied for a mortgage on it at the real estate bank in the name of my son from the wife who lives in Tabuk . It was built with two floors. The entire first floor was occupied by my wife and our children. The second floor consists of two apartments. One apartment was occupied by our son, his wife, and their children. The other apartment was rented out, and its rent was spent on my wife who lives in Tabuk and her children. After that, a residential plot of land was purchased in Al-Ula province, also with my personal funds and without anyone’s help. I applied for a mortgage on it in my own name at the real estate bank. It was built with two floors, each floor being an apartment. My wife and my children from her occupied the second floor. The first floor was rented out, and the rent from the first floor is spent on my wife and my children from her. Each wife has her own residence, and her expenses are paid from an apartment in the same building where she lives. The problem is that my wife who lives in Tabuk wants me to vacate the first floor of my building in Al-Ula so that she can have it to live in when she visits during
the school holidays in Al-Ula . It would remain locked for the rest of the year at her expense, even though she has an apartment in Tabuk , an apartment for her son, and a rented apartment at her expense from which her expenses are paid. I fear Allah greatly and am committed, praise be to Allah, and I want to clear my conscience of any error due to this request from my wife, who wants to encroach upon something that has no relation to her as long as I am alive. Therefore, I ask Allah, then your Eminence, to inform me about this matter. Does she have the right to take an apartment for herself in my building in Al-Ula , where my wife who lives in Al-Ula occupies one of the apartments? And since I have no income, and each wife’s residence is in a building and her expenses are paid from an apartment in it, I ask for information so that I do not fall into error. May Allah preserve you and care for you.
A: It is obligatory for you to house each of your two wives and your children and to provide for them with what suffices them. As for the two buildings, they are your property, and their returns belong to you; you may dispose of them according to your need and your judgment. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
