The fourth question of Fatwa No. ( 6028 )
Q4: A man lent me one hundred riyals. After some time, he asked me to give him back the hundred, which was his right. I told him, "I do not have the time right now." So he went to people and complained about the matter. We met at the home of one of these people, and they pressed me to give him his right. I denied that I had any money with him, and I did not swear an oath to him. Today, I inquired about him so that I could give him his right, and they told me that he has passed away. I do not know his family or his residence. Please provide a ruling. May Allah reward you with good in this world and the Hereafter.
A4: First: It is obligatory for you to seek forgiveness from Allah and repent to Him for the lie and denial of a creation's right that you committed, with a sincere repentance in which you regret your action and resolve not to return to such a thing, so that perhaps Allah will accept your repentance. Second: You must do your utmost to identify the heirs of the one who had the right, and return to them the right of their deceased. If you do not identify them, give it in charity on behalf of its owner. When you do identify his heirs, give them the choice between paying their money to them, in which case the reward is for you, or accepting the charity, in which case the reward is for them.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad and his family and his Companions.
