The third question of Fatwa No. ( 5726 )
Q3: Ihram at al-Juhfah for the people of Sham and the Maghrib : We continue to hear that al-Juhfah was a village on the seashore like Jeddah , and the sea has swept it away. Was that before the time of the Messenger of Allah or after? We know the authentic hadiths that it is for the people of Sham and the people of the Maghrib , but is it for all the people of the Maghrib , even those on the equator like Congo and central Sudan ? Or can they perform ihram at Jeddah , since that is where they pass by, or is it obligatory for everyone to perform ihram at the sea, because al-Juhfah is now in the sea?
A3: The Messenger of Allah (peace and blessings be upon him) designated the miqats for Hajj and 'Umrah, as narrated by al-Bukhari and Muslim from Ibn 'Abbas (may Allah be pleased with them both), who said:. In another narration from him: Sunan an-Nasa'i 2658Sahih (Darussalam). Therefore, every Muslim who passes by one of these miqats while intending to perform Hajj or 'Umrah must perform ihram for what he intends from the miqat he passes by, whether he is from the people of these mentioned lands or from elsewhere; because of his statement in the hadith: Sahih Muslim 1181a. And whoever is outside these miqats and his route does not pass through one of them performs ihram for what he intends when he is level with the first miqat he passes by, whether by land, sea, or air, even if his original miqat was al-Juhfah , he performs ihram today when he is level with it. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

The Messenger of Allah (peace and blessings be upon him) designated Dhu al-Hulayfah for the people of Madinah, al-Juhfah for the people of Sham, al-Qarn al-Manazil for the people of Najd, and Yalamlam for the people of Yemen. These are for them and for anyone who comes to them from among those who are not their people, from those who intend Hajj or 'Umrah. And whoever is beyond that, his place of ihram is from where he begins, even the people of Makkah from Makkah.
If a person's place of residence is within the boundary of they Miqat, then (he should enter Ihram) from where he starts his journey, and this also applies to the people of Makkah.
فمن كان دون ذلك فمهله من أهله حتى أن أهل مكة يهلون منهاand those (Mawaqit) are also meant for those who live at these (places) and for those too who come from without towards them for the sake of Hajj or 'Umra
