Fatwa number ( 16214 )
Q: What is the ruling on selling date palm fruit before it is pollinated, is it permissible to sell it before it ripens? I ask for guidance on this matter.
A: Selling date palm fruit before it is pollinated is not permissible, and likewise, after pollination, it is not permissible to sell it on its own until its ripeness becomes apparent. However, if he sells it together with its root—that is, with the date palm—there is nothing wrong with it; for in that case, it is an accessory to the root, not independent on its own. This is based on the saying of the Prophet (peace and blessings be upon him):Sahih Muslim 1543a It is agreed upon that it is authentic.
And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

If anyone buys palm-trees after they have been fecundated the fruit belongs to the seller unless the buyer makes a proviso.
