Q3: Is it permissible to sell dates while they are on the palm tree for an unlimited period or not?
A3: Selling the fruit on the tops of the date palms is permissible if it is not for dates, such as being sold for currency, but on the condition that the term is specified if it is not cash, and on the condition that the fruit has shown its ripeness; because if the
term is not specified, it falls under sales involving excessive uncertainty (gharar). And Allah the Exalted said:[Al-Baqarah 2:282] the verse. And if it is for dates, it is not permissible; due to the lack of knowledge of equality, except in the case of 'araya, with its known conditions. And success is from Allah, and may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
