The questioner : It happened that a girl died at six months of age and was buried with a fetus that had been aborted in the sixth month of pregnancy in its mother's womb. Is this permissible or not? And if not, what is the ruling on those who buried them in one grave?

The Shaykh : It is prescribed that every deceased person be buried in a separate grave. This is the Sunnah (recommended practice) that the Muslims have followed from the time of the Prophet (peace and blessings be upon him) until this day. However, if there is a need to bury two or more people in one grave, there is no blame on them. It is established in the two Sahihs (authentic collections) and others that the Prophet (peace and blessings be upon him) would combine two or three of the martyrs of Uhud in one grave due to the need for it. This girl and this fetus, who were combined in one grave, do not have to be exhumed because the time has passed. And whoever buried them in one grave while ignorant of this bears no sin. But what is required of everyone who performs an act of worship or otherwise is to know the limits of Allah the Exalted in that act before engaging in it, so that they do not fall into what is prohibited by the Shari'ah. Yes.
