First: Regarding a mosque that contains a grave, one must look at whether the mosque was built on top of the grave, or whether the mosque existed first and the deceased was buried in it.As for the first: Therefore, prayer in it is not valid; this is because it is a place where staying is forbidden and not valid, and no person is permitted to pray in a spot that is forbidden for him, especially in matters related to worship; because a mosque built on a grave leads to exalting the person in the grave,So, to block the means to shirk, we say: this is forbidden, and the one praying is sinful, and his prayer is not valid,And the evidence is the saying of the Prophet (peace and blessings be upon him): (Whoever does an action that is not in accordance with our command, it is rejected), and praying in mosques built on graves is prohibited without doubt,If the Prophet (peace and blessings be upon him) says: (Do not pray toward the graves) meaning: do not make them your qiblah, so how about one who prays in a mosque built on a grave?! As for if the mosque existed before the grave and the deceased was buried in it, then if the deceased is in the direction of the qiblah, it is not permissible to pray toward him, rather one must turn to the right or left of him, and if he is not in the direction of the qiblah, there is no harm, but in this case, it is obligatory to exhume the deceased and bury him in the place where people are buried.
