Q: What is your opinion on selling a car for ten thousand cash, or twelve thousand on installments? As is now common in car showrooms.
A: If a person sells a car or something else to another for ten thousand riyals, for example, in cash, or for twelve thousand riyals, for example, on credit, and they separate from the place of the contract without agreeing on one of the two prices: the cash price or the credit price, the sale is not permissible and is not valid; because of the ambiguity of the state in which the sale ended, whether it was cash or credit. Many scholars have cited as evidence for this the prohibition of the Prophet (peace and blessings be upon him) of two sales in one sale, narrated by Ahmad, al-Nasa'i, and al-Tirmidhi, who graded it as authentic. If the two parties agree on one of the two prices, the cash price or the credit price, before they separate from the place of the contract, and then they separate after the specification, the sale is permissible and valid; because of the knowledge of the price and its state.
