The questioner : If a man is in a state of major ritual impurity, which obligates him to perform the full ritual bath, and at the same time he is suffering from an illness that prevents him from washing with water, does dry ablution with clean earth suffice in place of the full ritual bath with water, even if the impediment is removed after several days? And does dry ablution with clean earth for removing major ritual impurity suffice in place of the ablution for prayer if the time for the obligatory prayer enters at the same time as the performance of the removal of major ritual impurity? Please inform us of this, and may you be rewarded?
The Shaykh : Praise be to Allah, Lord of the worlds, and I send prayers and peace upon our Prophet Muhammad, the Seal of the Prophets and the Imam of the righteous, and upon his family and all his Companions. If a man or a woman is in a state of major ritual impurity and is ill such that he or she is unable to use water, then in this state he or she performs dry ablution with clean earth, based on the saying of Allah, Blessed and Exalted is He:[Al-Ma'idah 5:6] And if one performs dry ablution with clean earth for this major ritual impurity, he does not repeat the dry ablution for it again unless a new major ritual impurity occurs. However, he performs dry ablution with clean earth for the ablution every time his ablution is broken. Dry ablution with clean earth removes the state of ritual impurity and purifies the one who performs it, based on the saying of Allah the Exalted when He mentioned dry ablution with clean earth, and before it He mentioned the ablution and the full ritual bath. He said, Mighty and Majestic: [Al-Ma'idah 5:6] And it is established from the Prophet (peace and blessings be upon him) that he said: Sunan Ibn Majah 567Sahih (Darussalam) And purity is that by which a person purifies himself. This indicates that dry ablution with clean earth is purifying, but its purity is conditional upon the removal of the impediment to using water. If the impediment to using water is removed, whether the patient recovers or water is found after being absent, then it is obligatory for him to perform the full ritual bath if his dry ablution was for major ritual impurity, and to perform the ablution if his dry ablution was for minor ritual impurity. What indicates this is what al-Bukhari narrated from the long hadith of Abu Sa'id, in which the Prophet (peace and blessings be upon him) saw a man sitting apart from the people who were praying. He asked him what prevented him from praying. He said: "O Messenger of Allah, I was in a state of major ritual impurity and there was no water." He said: Sahih al-Bukhari 348 Then water came to the Messenger of Allah (peace and blessings be upon him), and the people drew water from it, and a remainder was left. He said to the man: This is evidence that dry ablution with clean earth is purifying and sufficient in place of water, but if water is found, it is obligatory to use it. For this reason, the Prophet (peace and blessings be upon him) ordered him to pour it on himself without a new major ritual impurity having occurred. And this is the stronger position among the opinions of the scholars. Yes.
