Fatwa No. ( 18017 )
Q: I am presenting to your eminence, with all hope of issuing a fatwa on the following topics: First, we have a clinic in the Tabuk region that provides services
delivery for 800 riyals, including the medical tests specific to pregnancy throughout the duration of the pregnancy. The pregnant woman visits the obstetrics and gynecology clinic two to three times a month, and once a week in the last month of pregnancy, according to a special schedule given to the pregnant woman. This includes follow-up after delivery with two free home visits to ensure the mother's health, as well as the child receiving a free treatment card for a full year at the pediatric specialist clinic. Third: The Healthy Child Program, which costs 490 riyals and includes examining the child for a full year, which is the duration of the subscription. It also includes a discount on services provided within the clinic, such as X-rays, tests, and minor surgeries at 20%, and major operations at 15% at one of the private hospitals. The child is entitled to be examined up to three times a month throughout the duration of the subscription.

Third, the Healthy Child Program, which costs 490 riyals and includes checking on the child for a full year, which is the subscription period for the program, in addition to a discount on services provided within the clinic, such as 20% off X-rays, tests, and minor surgeries, and 15% off major operations at one of the private hospitals, and the child is entitled to be checked up to three times a month throughout the subscription period.

A: This work is a type of commercial health insurance, and it is forbidden; because it is a contract of gambling and excessive uncertainty, so the amount paid by the insured to obtain a discount for a year or more or less may not benefit him
at all; because he does not need the clinic for that period, so he loses his money and the clinic gains it, and he may benefit greatly, exceeding what he paid by a multiple, so the clinic gains and loses, so the winner of the two is a gainer in his bet, and the loser is a loser in it. And this work is the very gambling forbidden by the explicit text of the Book, Allah the Exalted said:
O you who have believed, indeed, intoxicants, gambling, [sacrificing on] stone alters [to other than Allah], and divining arrows are but defilement from the work of Satan, so avoid it that you may be successful.
[Al-Ma'idah 5:90]
and the money in all of this is subject to excessive uncertainty, and
The Prophet (ﷺ) forbade the saleنهى النبي صلى الله عليه وسلم عن بيع الغرر
