Fatwa number ( 20136 )
Q: The owner of a shop for repairing and selling clocks, I have clocks that were left in the shop by their owners for the purpose of repair. I repaired these clocks, and they are currently with me in the shop. The owners of these clocks have not returned, and some of the clocks have been in the shop for five years or more. I have advertised for them three times at different intervals, and none of the owners have come. Since I am harmed by the presence of these clocks in several ways, the most important of which are: 1 - The costs of spare parts and repair labor. 2 - The fear of losing these clocks, as there are many of them. 3 - The desire to liquidate the shop and stop the clock business. I ask your eminence to provide the appropriate solution regarding how to deal with the clocks.
A: If the situation is as described, you may sell the clocks that their owners left with you
and give their price in charity to the poor or to charitable projects, with the intention that the reward belongs to their owners. You will have your reward for this work, if Allah wills. If one of them comes asking for his clock, inform him of the reality. If he is satisfied, that is good and excellent. Otherwise, pay him the value, and you will have the reward of what you gave in charity. If they did not pay you the fee for repairing their clocks, you may take it from the value, and the charity will be with the remainder.
