The questioner : He says: O honorable Shaykh, an important matter that has become prevalent in society is: the occurrence of infertility in some women, and perhaps there is a natural cause or causes for it, among which are: the use of some contraceptive pills in the early stages of marriage, second, the use of menstruation suppressants, third, matters plotted by enemies that we are unaware of. My question, O honorableThe Shaykh : Is it permissible for a husband to marry another woman because his offspring have been delayed for several years, while he loves his wife, but he fears injustice toward her in a matter in which she has no involvement? What is your guidance, O honorable father? And do you know of a Sharia-compliant remedy for this? May Allah benefit us through you?
The Shaykh : I say: Glory be to Allah! In this era, infertility has become prevalent, and so has deformity; deformity is common in fetuses. This is because some women, may Allah guide them, use medications to stop menstruation or to stop pregnancy, so the woman is punished for this, and the husband who permits her to do so is also punished. Therefore, I advise my brothers to leave things to their natural course. If the offspring are numerous, this is a blessing from Allah (Mighty and Majestic), and this is what the Prophet (peace and blessings be upon him) intended for this Ummah, as he said:Sunan al-Bayhaqi 10:870. As for his question: Is it permissible for him to marry another woman over her? We say: Yes, marry another woman over her, even if she is giving birth. Marry a second wife. If you wish and you have the financial and physical capacity, marry a third. If you have the capacity, marry a fourth. The more wives there are, the better, provided the person has the financial and physical capacity, and the capacity for justice, meaning: he treats them with justice. But if he fears that he will not be just, or if he is poor, or if he does not have the capacity, then here we say: limit yourself to one. Yes.
