All praise is due to Allah alone, and may blessings and peace be upon His Messenger, his family, and his Companions. And to proceed: The Permanent Committee for Scholarly Research and Ifta has reviewed the inquiry submitted to His Eminence the General President by the Ministry of Foreign Affairs, registered with the Research Department under number 2144 on 27/12/1401 AH, the text of which is as follows: 31/1613/1 Urgent, exclusively for the Undersecretary of the Ministry of Health for Health Affairs Riyadh , with greetings to the office of the Prime Minister for information only, with greetings to the Ministry of Interior for Administrative Affairs for information only, with greetings to the Governorate of the Makkah Region, and with greetings to the General Presidency for Research, Ifta, Da'wah, and Guidance, requesting your opinion on this matter only, Riyadh . The Indonesian embassy in Jeddah has written to us that its government hopes the Kingdom's government will agree to transfer the body of the deceased Hajj Bung Tomo, Mr. Sumitro, from his grave at 'Arafah to Indonesia after he died there and was buried there on the ninth of Dhu al-Hijjah 1401 AH, given that he is one of the national leaders in Indonesia , and his family is urgently requesting to bury him in his homeland. Since this request conflicts with the teachings of the pure Shari'ah and the dignity of the deceased, as it is not permissible to exhume his grave after his death, in addition to the fact that it constitutes a clear violation of the health directives issued by the World Health
Organization, and with health regulations in general. We hope you will inform us of your opinion on this matter at the earliest possible opportunity. Please note that a copy of this telegram has been provided to the General Presidency for Research, Ifta, Da'wah, and Guidance for the same purpose.

And it responded as follows: If the situation is as described, it is not permissible to transfer the body of the aforementioned deceased from his grave at 'Arafah to his place of birth in Indonesia ; in order to protect the deceased himself and preserve his sanctity, and because the Prophet (peace and blessings be upon him) and his Companions (may Allah be pleased with them) did not do such a thing, and what is mentioned in the inquiry is not a valid legal justification for transferring him. And success is from Allah, and may Allah send blessings and peace upon our Prophet Muhammad, his family, and his Companions.
