Q2: It is established in the authentic hadith narrated by Abu Hurayrah and 'Amr ibn al-'As (may Allah be pleased with them both), the saying of the Messenger (peace and blessings be upon him):Jami` at-Tirmidhi 1326Sahih (Darussalam) . Is this ruling specific to the one in authority and the judge, or does it encompass students of knowledge and da'iyah who exercise ijtihad in matters related to calling people to Allah, and in choosing the righteous paths for da'wah in their lands, sometimes erring and sometimes hitting the mark? And is it permissible for them to exercise ijtihad in such matters, or is it not permissible for them except to follow the opinions of the great scholars who are trusted for their knowledge and virtue?
A2: The hadith encompasses the judge who adjudicates disputes and the mujtahid who derives Islamic legal rulings from their detailed evidence - if both possess the conditions of ijtihad specified by the scholars in the books of usul al-fiqh, and likewise the da'iyah to Allah who possess the conditions of ijtihad.
