What is your opinion regarding someone who buys, for example, a basket of Shuqar dates weighing three kilograms for a basket of Sukkari dates weighing three kilograms plus an additional twenty riyals?

Machine translationRead the Arabic original
The questioner : He says: Peace be upon you, and Allah's mercy and blessings. What is your opinion regarding someone who buys, for example, a basket of Shuqar dates weighing three kilograms for a basket of Sukkari dates weighing three kilograms plus an additional twenty riyals?

The Shaykh : This is not permissible because dates are of one type, and it is not permissible for one part of a single type to be increased over another. The evidence for this is that the Messenger of Allah (peace and blessings be upon him) was brought dates, good dates, and he said:
Where did this come from? They said: We used to buy one sa' of this for two sa's, and two sa's for three. He said: Return it, this is pure riba. من أين هذا ؟ قالوا : كنا نشتري الصاع من هذا بصاعين، والصاعين بالثلاثة، فقال : ردوه، هذا عين الربا
Then he guided them, may Allah's peace and blessings be upon him, to sell the bad dates for a price and buy good dates with that price, but from someone other than the seller. He sells them in the market, then takes the money and buys good dates. So the basket of Sukkari may be more expensive in price than the basket of Shuqar, so it is not permissible to sell one for the other with a difference in quantity or an addition of money.

The questioner : He says: What is the ruling on one who sells tobacco?

The Shaykh : He sells what?

The questioner : Tobacco and clothes that have images on them.

The Shaykh : What?

The questioner : And clothes that have images on them, is this a permissible sale? And is the profit he finds lawful or forbidden?

The Shaykh : It is not permissible for a person to sell tobacco, because tobacco is forbidden, and when Allah forbids something, its price is forbidden. Also, selling it falls under the category of cooperating in sin and aggression. Likewise, clothing that contains complete images is not permissible to sell, because selling it leads to wearing it, and wearing it is forbidden. However, if it contains only faces, it is not forbidden. Similarly, diapers that are tied around the front or back of a boy are not a problem to sell or buy, even if they contain images, because they are extremely degraded, as they are discarded in the place of harm and filth.
