Questions three and five from Fatwa No. ( 9407 ):
Q3: What is the interpretation of this verse? Allah says in His noble Book: up to His saying: [Al-Ma'idah 5:107] .
A3: This verse completes the previous verse regarding the ruling on the testimony of non-Muslims in a bequest while traveling. The meaning of this verse is: If it is discovered and becomes apparent that the two executors have incurred sin due to their treachery and their false oaths, then two from among the heirs of the deceased shall take their place. They shall swear by Allah that their oaths are truer than those of the executors, and then judgment shall be given to the heirs. You may refer to a detailed explanation of this verse in [Tafsir Ibn Jarir and al-Baghawi and Ibn Kathir ] (may Allah have mercy on them all).
Q5: What is the meaning of His saying, the Exalted:[Al-Ma'idah 5:35] in the verse?
A5: Allah the Exalted said:[Al-Ma'idah 5:35] . Allah, the Exalted, commanded the believers to have taqwa (mindfulness of Allah) and to seek the wasilah (means of nearness) to Him and to draw near to Him, the Exalted, by performing acts of obedience and by fighting the disbelievers to raise the word of Allah, hoping to attain success with Allah. Al-Khazin says in his tafsir (may Allah have mercy on him): The sum of obligations is confined to two types, with no third. One type is leaving off what is prohibited, to which His saying, the Exalted, points: . The second is drawing near to Allah, the Exalted, through acts of obedience, to which His saying points: [Al-Ma'idah 5:35] . Al-Wasilah is a form of the verb wasala ilayhi (to approach him) when one draws near to him. It is also said that the meaning of al-wasilah is love, meaning: seek to be loved by Allah, the Mighty and Majestic. By this, you understand the meaning of His saying, the Exalted: [Al-Ma'idah 5:35] which is: drawing near to Him by what He has prescribed of acts of obedience, such as prayer, fasting, charity, and types of dhikr (remembrance of Allah), and others. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
Q3: What is the interpretation of this verse? Allah says in His noble Book:
If it is discovered that they have incurred
فَإِنْ عُثِرَ عَلَى أَنَّهُمَا اسْتَحَقَّاIndeed, we would then be of the wrongdoers."
