Question: I ask you to explain the saying of Allah the Exalted: [al-Ma'idah: 3], and then, is it forbidden to eat the meat of the one that fell and the one that was gored when it dies immediately as a result, or is it forbidden to eat it even if it remains for a long time and you slaughter it afterwards?
Answer: Allah says, addressing His believing servants whom He called out at the beginning of this great surah with His saying: [al-Ma'idah: 1],The Exalted said:[Al-Ma'idah 5:3]: That is, Allah, Glorified and Exalted is He, has forbidden you to eat carrion,And carrion: which is that which died without lawful slaughter, and the evidence has specified the carrion of fish and locusts, as the Prophet (peace and blessings be upon him) said: . So Allah has made the carrion of fish and locusts lawful, and everything else is forbidden.
And carrion, as we mentioned, is that which died without lawful slaughter.
[Al-Ma'idah 5:3]: The blood here is general, but the second verse qualified it with "poured out";As Allah the Exalted said: [al-An'am: 145].
And what is meant by it: That is the blood that comes out of the slaughtered animal at the time of its slaughter and spurts from its jugular veins, whereas the blood remaining in the veins and meat of the slaughtered animal is excused, and there is no harm in eating it with the meat.
And two types of blood were excepted from the prohibition, which were mentioned in the hadith:, so blood is forbidden, and what is meant by it is poured-out blood, whereas the blood remaining in the veins after slaughter and in the meat is excused, and likewise the liver and spleen which were excepted in the hadith.
: The pig is the animal known for its filth and baseness, and Allah has forbidden its consumption because of the severe harms it contains and the serious diseases it begets, as the people of medicine have established, for the pig contains germs and serious diseases, which have been discovered and continue to be discovered, and Allah, Exalted and Majestic is He, does not forbid His servants anything except what is harmful to them.
[Al-Ma'idah 5:3]
And what is mentioned over it other than the name of Allah the Exalted includes two types:
It includes that which is offered to other than Allah, even if the name of Allah is invoked over it.
And it includes that which is slaughtered for other than an offering and a name other than the name of Allah, Glorified and Exalted, is invoked over it at the time of slaughter.
And what is meant by the dedication: Raising the voice, this is in the original sense, and what is meant by it here is what we mentioned.
: They said: This is a detail of the carrion, which Allah mentioned at the beginning of the verse, and it is that which strangled itself and confined itself with a rope or other thing, with something narrow until it died, due to the strangulation.
: That which was struck with a heavy object and died from the strike, even if blood came out of it; because the heavy object does not wound it, but kills it with its weight, and bruises it, and it dies due to the weight, so this is the one that was struck to death.
: It is that which fell from a high place, such as a roof or a mountain or a wall or a pit or into a well, and died due to the fall.
[Al-Ma'idah 5:3]: The predator that devours with its fangs, from the wolves and lions and other predatory beasts that pierce with their fangs or their claws, a bird of prey, or a beast of prey, that devours with its fang or its claw, so if it strikes an animal and it dies due to its strike, then it is not to be eaten.
[Al-Ma'idah 5:3]: This is an exception from what preceded,Meaning: except what you catch alive from these things: the strangled, the struck to death, the one that fell, the one that was gored, and what the predator ate, if you catch it after it was struck by one of these matters, and it has stable life and you slaughter it lawfully, then it is lawful; because the conditions of permissibility are present in it, which are lawful slaughter.
As for what you catch and it has died due to the strike, or you catch it alive in its last breath, its life is not stable, the life of one being slaughtered, this also is not lawful,And some of the scholars of knowledge said: if what you catch has the least life and you slaughter it, then it is lawful, but the majority are of the opinion that what has unstable life, like the movement of one being slaughtered, this is not lawful by its slaughter; because it is in the ruling of the dead.
[Al-Ma'idah 5:3]And it was said: they slaughter the sacrifice on the very stones to venerate them, so these are polytheistic sacrifices slaughtered to venerate these standing stones, so they are among what is not lawful to eat, and this is an explanation of what was done in the pre-Islamic age of ignorance, this is the meaning of this noble verse.
And as for the rest of the question, what is caught of the strangled, the struck to death, and the one that fell, we have answered it, that if you catch it and it has stable life and you slaughter it, it is lawful, and if you catch it and it is dead or in its last breath, which is like the movement of one being slaughtered, this is a matter of disagreement among the scholars, and the majority are of the opinion that it is not lawful.
So the one who catches it after it has been struck has three states:
The first case: That it is caught and it is dead, this is forbidden by consensus.
The second state: That it is caught and it has stable life, this is lawful by consensus if you slaughter it lawfully.
The third state: If you catch it and it has unstable life, life on the path of vanishing, like the movement of one being slaughtered, this is the matter of disagreement.
Prohibited to you are dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah, and [those animals] killed by strangling or by a violent blow or by a head-long fall or by the goring of horns, and those from which a wild animal has eaten, except what you [are able to] slaughter [before its death], and those which are sacrificed on stone altars

O you who have believed, fulfill [all] contracts.
يَاأَيُّهَا الَّذِينَ آمَنُوا أَوْفُوا بِالْعُقُودِProhibited to you are dead animals
حُرِّمَتْ عَلَيْكُمُ الْمَيْتَةُTwo carrions and two bloods have been made lawful, as for the two carrions: they are fish and locusts
أحلت ميتتان ودمان، أما الميتتان: فالسمك والجرادAnd carrion, as we mentioned, is that which died without lawful slaughter.
Prohibited to you are dead animals, blood
حُرِّمَتْ عَلَيْكُمُ الْمَيْتَةُ وَالدَّمُI do not find within that which was revealed to me [anything] forbidden to one who would eat it unless it be a dead animal or blood spilled out
And what is meant by it: That is the blood that comes out of the slaughtered animal at the time of its slaughter and spurts from its jugular veins, whereas the blood remaining in the veins and meat of the slaughtered animal is excused, and there is no harm in eating it with the meat.
And two types of blood were excepted from the prohibition, which were mentioned in the hadith:
Two types of carrion and two types of blood have been made lawful for us, and as for the blood, it is the liver and the spleen.
أحلت لنا ميتتان ودمان، وأما الدمان فالكبد والطحالand the meat of the pig
وَلَحْمُ الْخِنْزِيرِand that which has been dedicated to other than Allah

and the strangled
وَالْمُنْخَنِقَةُAnd that which is killed by a heavy blow
وَالْمَوْقُوذَةُAnd that which falls from a height
وَالْمُتَرَدِّيَةُAnd that which is killed by goring
وَالنَّطِيحَةُthose from which a wild animal has eaten
وَمَا أَكَلَ السَّبُعُProhibited to you are dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah, and [those animals] killed by strangling or by a violent blow or by a head-long fall or by the goring of horns, and those from which a wild animal has eaten, except what you [are able to] slaughter [before its death], and those which are sacrificed on stone altars, and [prohibited is] that you seek decision through divining arrows. That is grave disobedience. This day those who disbelieve have despaired of [defeating] your religion; so fear them not, but fear Me. This day I have perfected for you your religion and completed My favor upon you and have approved for you Islam as religion. But whoever is forced by severe hunger with no inclination to sin - then indeed, Allah is Forgiving and Merciful.
إِلَّا مَا ذَكَّيْتُمْAs for what you catch and it has died due to the strike, or you catch it alive in its last breath, its life is not stable, the life of one being slaughtered, this also is not lawful,And some of the scholars of knowledge said: if what you catch has the least life and you slaughter it, then it is lawful, but the majority are of the opinion that what has unstable life, like the movement of one being slaughtered, this is not lawful by its slaughter; because it is in the ruling of the dead.
those which are sacrificed on stone altars
وَمَا ذُبِحَ عَلَى النُّصُبِAnd as for the rest of the question, what is caught of the strangled, the struck to death, and the one that fell, we have answered it, that if you catch it and it has stable life and you slaughter it, it is lawful, and if you catch it and it is dead or in its last breath, which is like the movement of one being slaughtered, this is a matter of disagreement among the scholars, and the majority are of the opinion that it is not lawful.
