Q: Can we say to one who commits zina and drinks intoxicants: You are a disbeliever, or not?
A: It is not said to one who commits zina or drinks intoxicants: You are a disbeliever, according to the people of the Sunnah and the community, rather it is said of him: He is a believer to the extent of the faith in him, and an open sinner to the extent of the disobedience in him. As for what was reported of the saying of the Prophet (peace and blessings be upon him):Sahih al-Bukhari 5578 the hadith, it is understood as negating the perfection of the obligatory faith,
not as negating the original faith, as evidenced by the fact that it is established from the Prophet (peace and blessings be upon him) in the hadith of Abu Dharr in al-Bukhari that he said:Mishkat al-Masabih 26Muttafaqun 'alayh (Zubair `Aliza'i) , and Abu Dharr used to say when narrating this: And despite the nose of Abu Dharr, and Abu 'Abdullah said: (This is at the time of death or before it, if he repents and feels remorse, and says: There is no god but Allah, he is forgiven). And by this, the evidence of the promise and the threat are reconciled, and all of it is acted upon, and nothing of it is rejected. However, one who deems zina, theft, or drinking intoxicants, or other of the forbidden things upon which there is consensus of prohibition, permissible, disbelieves according to the people of the Sunnah and the community . And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
