Q3: What is the ruling on one who commits a major sin, such as murder, theft, or unlawful sexual intercourse, and the like, under a state that rules by other than the law of Islam , with the correct evidence?
A3: One who commits it while being a polytheist committing major shirk (associating partners with Allah), and then dies upon that, is eternally in the Fire. If he repents from it and from shirk and does good deeds, Allah forgives him and replaces his evil deeds with good ones. Allah the Exalted said:[Al-Furqan 25:68-70] And He said: [Az-Zumar 39:53-54], the verses... until His saying: [Az-Zumar 39:61] And His saying: [Al-Anfal 8:38] It is established from the Prophet (peace and blessings be upon him) that he said: , and whoever
commits sins other than shirk after entering Islam, the correct opinion regarding him is the opinion of the people of the Sunnah and the community : that he is a believer to the extent of the faith in him, and an open sinner to the extent of the major sins in him other than shirk with Allah. If he dies upon them without repenting, his case is entrusted to Allah according to the people of the Sunnah and the community . If He wills, He pardons him and forgives him because of his faith, and if He wills, He punishes him for his crime. Allah the Exalted said:[An-Nisa 4:48] And He said: [At-Tawbah 9:102], and from Abu Dharr (may Allah be pleased with him) he said: The Messenger of Allah (peace and blessings be upon him) said: Sahih al-Bukhari 1237 Narrated by al-Bukhari and Muslim and others. The authentic, mass-transmitted hadiths of intercession indicate this in detail, so refer to them in the authentic collections of al-Bukhari and Muslim and other books of the Sunnah. This is if they do not repent. As for one of them who repents, Allah has written upon Himself that He will accept his repentance, as is made clear from
the previous texts and others. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

(68) And those who do not invoke with Allah another deity or kill the soul which Allah has forbidden [to be killed], except by right, and do not commit unlawful sexual intercourse. And whoever should do that will meet a penalty. (69) Multiplied for him is the punishment on the Day of Resurrection, and he will abide therein humiliated - (70) Except for those who repent, believe and do righteous work. For them Allah will replace their evil deeds with good. And ever is Allah Forgiving and Merciful.
وَالَّذِينَ لاَ يَدْعُونَ مَعَ اللَّهِ إِلَهًا آخَرَ وَلاَ يَقْتُلُونَ النَّفْسَ الَّتِي حَرَّمَ اللَّهُ إِلا بِالْحَقِّ وَلاَ يَزْنُونَ وَمَنْ يَفْعَلْ ذَلِكَ يَلْقَ أَثَامًا (68) يُضَاعَفْ لَهُ الْعَذَابُ يَوْمَ الْقِيَامَةِ وَيَخْلُدْ فِيهِ مُهَانًا (69) إِلا مَنْ تَابَ وَآمَنَ وَعَمِلَ عَمَلا صَالِحًا فَأُولَئِكَ يُبَدِّلُ اللَّهُ سَيِّئَاتِهِمْ حَسَنَاتٍ وَكَانَ اللَّهُ غَفُورًا رَحِيمًا(53) Say, "O My servants who have transgressed against themselves [by sinning], do not despair of the mercy of Allah. Indeed, Allah forgives all sins. Indeed, it is He who is the Forgiving, the Merciful." (54) And return [in repentance] to your Lord and submit to Him before the punishment comes upon you; then you will not be helped.
قُلْ يَا عِبَادِيَ الَّذِينَ أَسْرَفُوا عَلَى أَنْفُسِهِمْ لاَ تَقْنَطُوا مِنْ رَحْمَةِ اللَّهِ إِنَّ اللَّهَ يَغْفِرُ الذُّنُوبَ جَمِيعًا إِنَّهُ هُوَ الْغَفُورُ الرَّحِيمُ (53) وَأَنِيبُوا إِلَى رَبِّكُمْ وَأَسْلِمُوا لَهُ مِنْ قَبْلِ أَنْ يَأْتِيَكُمُ الْعَذَابُ ثُمَّ لاَ تُنْصَرُونَAnd Allah will save those who feared Him by their attainment; no evil will touch them, nor will they grieve.
وَيُنَجِّي اللَّهُ الَّذِينَ اتَّقَوْا بِمَفَازَتِهِمْ لاَ يَمَسُّهُمُ السُّوءُ وَلاَ هُمْ يَحْزَنُونَSay to those who have disbelieved [that] if they cease, what has previously occurred will be forgiven for them. But if they return [to hostility] - then the precedent of the former [rebellious] peoples has already taken place.
قُلْ لِلَّذِينَ كَفَرُوا إِنْ يَنْتَهُوا يُغْفَرْ لَهُمْ مَا قَدْ سَلَفَ وَإِنْ يَعُودُوا فَقَدْ مَضَتْ سُنَّةُ الْأَوَّلِينَIslam wipes out what came before it.

إِنَّ اللَّهَ لاَ يَغْفِرُ أَنْ يُشْرَكَ بِهِ وَيَغْفِرُ مَا دُونَ ذَلِكَ لِمَنْ يَشَاءُAnd [there are] others who have acknowledged their sins. They had mixed a righteous deed with another that was bad. Perhaps Allah will turn to them in forgiveness. Indeed, Allah is Forgiving and Merciful.
وَآخَرُونَ اعْتَرَفُوا بِذُنُوبِهِمْ خَلَطُوا عَمَلا صَالِحًا وَآخَرَ سَيِّئًا عَسَى اللَّهُ أَنْ يَتُوبَ عَلَيْهِمْ إِنَّ اللَّهَ غَفُورٌ رَحِيمٌSomeone came to me from my Lord and gave me the news (or good tidings) that if any of my followers dies worshipping none (in any way) along with Allah, he will enter Paradise." I asked, "Even if he committed illegal sexual intercourse (adultery) and theft?" He replied, "Even if he committed illegal sexual intercourse (adultery) and theft."
أتاني آت من ربي فأخبرني - أو قال: بشرني - أنه من مات من أمتي لا يشرك بالله شيئًا دخل الجنة، قلت: وإن زنى وإن سرق؟ قال: وإن زنى وإن سرقthe previous texts and others. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
