The fifth question of Fatwa No. ( 6396 ):
Q5: What is the ruling on a person who does not perform any of the obligatory prescribed acts, such as prayer, even though he is healthy and well, does good to people, and stays away from evil, and says: "Indeed, Allah is Forgiving and Merciful; because I do not do evil, but I love to do good"? Also, some people pray and do good deeds, but there are things they do, such as zina, riba, or drinking intoxicants, even though they are careful to maintain all the prayers. What is the ruling on such a person?
A5: First: Abandoning prayer is major shirk, even if one does not deny its obligation, according to the most correct of the scholars' opinions; due to the saying of the Prophet (peace and blessings be upon him):Sunan Ibn Majah 1079Sahih (Darussalam) , and what came in its meaning in the hadiths. Second: Committing zina is a major sin among the major sins, as is dealing in riba and drinking intoxicants, and all these sins are major sins. The one who commits them does not leave Islam by committing them if he does not consider them permissible, but he is in great danger. If he dies while persisting in them, he is under the will of Allah (Glorified and Exalted is He); if He wills, He will forgive him, and if He wills, He will punish him according to the magnitude of his sin, and his ultimate destination is Paradise; due to the saying of Allah the Exalted: [An-Nisa 4:48] the verse. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

The covenant that distinguishes between us and them is prayer; so whoever leaves it, he has committed Kufr.
العهد الذي بيننا وبينهم الصلاة، فمن تركها فقد كفرIndeed, Allah does not forgive association with Him, but He forgives what is less than that for whom He wills
إِنَّ اللَّهَ لاَ يَغْفِرُ أَنْ يُشْرَكَ بِهِ وَيَغْفِرُ مَا دُونَ ذَلِكَ لِمَنْ يَشَاءُ
