The third question of Fatwa No. ( 222 ):
Q3: It is reportedthe cursing of image-makers (with kasrah) — does this include those who are depicted (with fathah)?And is there specific evidence regarding them?
A3: Just as the evidence was reported regarding the cursing of the image-makers and their threat with the Fire in the Hereafter, so too does the one who offers himself in order to have his image taken fall under that. Allah the Exalted said:
And it has already come down to you in the Book that when you hear the verses of Allah [recited], they are denied [by them] and ridiculed; so do not sit with them until they enter into another conversation. Indeed, you would then be like themوَقَدْ نَـزَّلَ عَلَيْكُمْ فِي الْكِتَابِ أَنْ إِذَا سَمِعْتُمْ آيَاتِ اللَّهِ يُكْفَرُ بِهَا وَيُسْتَهْزَأُ بِهَا فَلا تَقْعُدُوا مَعَهُمْ حَتَّى يَخُوضُوا فِي حَدِيثٍ غَيْرِهِ إِنَّكُمْ إِذًا مِثْلُهُمْ
[An-Nisa 4:140]
And Allah the Exalted said regarding the story of Thamud :
(11) Thamud denied [their prophet] by reason of their transgression, (12) When the most wretched of them was sent forth. (13) And the messenger of Allah [Salih] said to them, "[Do not harm] the she-camel of Allah or [prevent her from] her drink." (14) But they denied him and hamstrung her. So their Lord brought down upon them destruction for their sin and made it equal [upon all of them]. (15) And He does not fear the consequence thereof.كَذَّبَتْ ثَمُودُ بِطَغْوَاهَا (11) إِذِ انْبَعَثَ أَشْقَاهَا (12) فَقَالَ لَهُمْ رَسُولُ اللَّهِ نَاقَةَ اللَّهِ وَسُقْيَاهَا (13) فَكَذَّبُوهُ فَعَقَرُوهَا فَدَمْدَمَ عَلَيْهِمْ رَبُّهُمْ بِذَنْبِهِمْ فَسَوَّاهَا (14) وَلاَ يَخَافُ عُقْبَاهَا
[Ash-Shams 91:11-15]
, and 'Abd al-Wahhab ibn Zayd said: I said to al-Hasan : (O Abu Sa'id, inform me about a man who did not witness the fitnah of Abu al-Muhallab except that he approved of it with his heart. He said: O my nephew, how many hands slaughtered the she-camel? I said: One hand. He said: Did not the people all perish by their approval and their acquiescence?)? It was narrated by the Imam Ahmad in [al-Zuhd]. So these two verses indicate that
the one who approves of an act is like the doer of it, and this does not include the one for whom necessity requires that he have his image taken. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
