Q2: When is declaring someone a disbeliever permissible and when is it not permissible? And what is the type of disbelief mentioned in the saying of Allah the Exalted:
And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers.وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْـزَلَ اللَّهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ
[Al-Ma'idah 5:44]

Part 2: As for your statement: "When is it permissible to declare someone a disbeliever and when is it not?" we see that you should clarify the matters that have confused you so that we can explain the ruling in them. As for the type of disbelief in the saying of Allah the Exalted:
And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers.وَمَنْ لَمْ يَحْكُمْ بِمَا أَنْـزَلَ اللَّهُ فَأُولَئِكَ هُمُ الْكَافِرُونَ
[Al-Ma'idah 5:44]

Al-Qurtubi said in his tafsir: " Ibn 'Abbas (may Allah be pleased with them both) and Mujahid (may Allah have mercy on him) said: 'Whoever does not judge by what Allah has revealed, out of rejection of the Qur'an and denial of the saying of the Messenger of Allah (peace and blessings be upon him), is a disbeliever.' End of quote." As for the one who judges by other than what Allah has revealed while believing that he is disobeying Allah, but what led him to judge by other than what Allah has revealed is the bribe given to him or something like that, or his enmity toward the one being judged against, or his kinship or friendship with the one being judged for, or the like of that—this does not make his disbelief major; rather, he is a sinner against Allah, and
And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
