Q: What is the statement of the scholars of Islam and the noble jurists regarding the sect of the Ismailis - the Aga Khanis - whose members reside in various countries, especially in the northern countries of Pakistan ? We mention some of their beliefs and sayings here that indicate their creed: (1) The Word: They say, "I bear witness that there is no god but Allah, and I bear witness that Muhammad is the Messenger of Allah, and I bear witness that the Commander of the Faithful is Ali." This is their word, which they place in the position of the word of Islam, the word of tawhid (the oneness of Allah), and the testimony, and they call it: the true Islamic word. (2) The Imam: They believe that Aga Khan Shah Karim is their Imam, and that he is the owner of everything in the earth, the heavens, and what is between them, in good and evil, and they believe that he is the ruler of the world in all its affairs. (3) The Shari'ah: They do not consider it necessary to follow the Islamic Shari'ah; rather, they believe that the Aga Khan is the speaking Qur'an and the true, original Qur'an, that he is the Ka'bah, that he is the inhabited House, that he is the one who is followed and the one who is obeyed, and that nothing other than him must be followed. In their books, it is stated that the reference for the term "Allah" mentioned in the apparent Qur'an is the Imam, the Aga Khan. (4) Prayer: They do not believe that the five daily prayers are obligatory, and they say that three supplications are obligatory in their place. (5) The Mosque: They take another place of worship in place of the mosque and call it: Jama'at
Khana. (6) Zakah: They deny the zakah prescribed by the Shari'ah and pay in its place, from all categories of wealth, a tenth to the Aga Khan, which they call: the money of obligations - Dushwand. (7) Fasting: They deny the obligation of fasting in Ramadan. (8) They do not affirm the obligation of performing Hajj to the House; they believe that the original Hajj is the Aga Khan. (9) Greeting: They have a specific greeting in place of "As-salamu alaykum"; when they meet, they say: (Ali Madad), meaning "May Ali help you," and they say in response: (Mawla Ali Madad) in place of "Wa alaykum as-salam." This is a brief summary of their statements and beliefs. Now we ask about several matters: (1) Is this sect one of the Islamic sects or one of the sects of disbelief? (2) Is it permissible to pray the funeral prayer over their dead? (3) Is it permissible to bury them in Muslim cemeteries? (4) Is it permissible to marry them? (5) Is their slaughter permissible? (6) Are they to be treated as Muslims? We ask you, in the name of the Great Allah, to issue a ruling on this inquiry and to remove doubts from the hearts of Muslims; for these people have been concealing their beliefs until now, which is why the earlier scholars called them: the Batiniyyah . Now they have openly displayed their beliefs and are calling people to them openly; seeking to mislead Muslims in their beliefs and for other reasons we do not know.
A: First: The belief that Allah dwelt in Ali or anyone else is pure disbelief that expels one from the religion of Islam. Likewise, the belief that there is someone who acts in the heavens and the earth other than Allah, the Exalted, is also disbelief. Allah the Exalted said:[Al-A'raf 7:54]
Second: Whoever believes that there is someone who is permitted to deviate from following the Shari'ah of Muhammad (peace and blessings be upon him) is a disbeliever, with a disbelief that expels one from the religion of Islam. His Shari'ah is the Qur'an that Allah revealed to him. Allah the Exalted said:[Al-Isra 17:106]. And part of the Shari'ah is the Prophetic Sunnah, which clarifies and details the Qur'an. Allah the Exalted said: [An-Nahl 16:64]. Third: Whoever denies or rejects any of the pillars of Islam or any of the obligations of the religion that are known by necessity is a disbeliever and an apostate from the religion of Islam. Fourth: If the reality of this sect is as you mentioned in the question, then it is not permissible to pray the funeral prayer over their dead, nor to bury them in Muslim cemeteries, nor to marry them, nor is their slaughter permissible, nor are they to be treated as Muslims. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.

وَقُرْآنًا فَرَقْنَاهُ لِتَقْرَأَهُ عَلَى النَّاسِ عَلَى مُكْثٍ وَنَـزَّلْنَاهُ تَنْـزِيلاAnd We have not revealed to you the Book, [O Muhammad], except for you to make clear to them that wherein they have differed and as guidance and mercy for a people who believe.
وَمَا أَنْـزَلْنَا عَلَيْكَ الْكِتَابَ إِلا لِتُبَيِّنَ لَهُمُ الَّذِي اخْتَلَفُوا فِيهِ وَهُدًى وَرَحْمَةً لِقَوْمٍ يُؤْمِنُونَ
