Q5, 6: Is it permissible for me to demolish the shrines that contain the tombs of shaykhs who are called: the awliya (close friends of Allah), and is it permissible for me to take from these shrines, after I have destroyed them, the roof and covering to benefit from them?
A5, 6: First: Building shrines and mosques over a grave or graves is forbidden; because it is established that the Prophet (peace and blessings be upon him) prohibited it and cursed whoever did it. If they are built, then it is obligatory upon the rulers of the Muslims and their assistants to demolish them; to remove
the evil, for they were established on other than piety. Likewise, if a group of Muslims has a stronghold and they have strength, then they should remove them. All of this is provided that there is no fear that demolishing them will incite a fitnah (trial, discord or temptation) that cannot be extinguished and put an end to. For the Prophet (peace and blessings be upon him) did not remove the idols that were on the Ka'bah and inside it at first, despite his call to tawhid (the oneness of Allah) and his mocking the dreams of the polytheists for their worship of idols. When the Muslims became strong, he removed them in the year of the Conquest of Makkah. Second: If you demolish them, it is permissible for you to take from their parts what you benefit from, if you are safe from fitnah and do not fear harm. And success is from Allah. May Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
