Fatwa number ( 4874 ):
Q: What is the ruling on building mosques over graves and what is the ruling on demolishing them if they are built over them?
A: It is not permissible to build mosques over graves; due to the prohibition of the Prophet (peace and blessings be upon him) from making graves into mosques and his cursing of whoever does so, and this includes building mosques over them and praying in them. If mosques are built over graves, they must be demolished; because they were established on a basis other than the Shari'ah method; and because keeping them and praying in them is a means to shirk (associating partners with Allah). And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
