The third question of Fatwa No. ( 4335 ):
Q3: Is it permissible for a person to pray in a mosque that contains a grave, and is it obligatory to kiss the threshold of the entrance to al-Husayn and Sayyidah Zaynab and to kiss the shrine and seek nearness to Allah through them and ask for their support and assistance? And is it permissible to travel from
one place to another to celebrate one of the Mawlid celebrations?

A3: First: If the mosque was built over a grave, then prayer in it is not permissible, and likewise if someone is buried in the mosque after it has been built. It is obligatory to move the one buried in it to the public cemeteries if that is possible; due to the generality of the hadiths indicating the prohibition of prayer in mosques that contain graves. Second: It is forbidden to kiss the threshold of the entrance to al-Husayn and Sayyidah Zaynab and others, and the shrine; because of what it contains of submission to other than Allah and exalting inanimate objects and the dead with an exaltation that Allah has not prescribed, and because that is among the means of associating partners with Allah regarding the people of the graves, and likewise seeking nearness to Allah through their persons or their right or their status. As for asking for their support and assistance, that is major shirk (associating partners with Allah); due to the saying of Allah the Exalted:
And whoever invokes besides Allah another deity for which he has no proof - then his account is only with his Lord. Indeed, the disbelievers will not succeed.وَمَنْ يَدْعُ مَعَ اللَّهِ إِلَهًا آخَرَ لاَ بُرْهَانَ لَهُ بِهِ فَإِنَّمَا حِسَابُهُ عِنْدَ رَبِّهِ إِنَّهُ لاَ يُفْلِحُ الْكَافِرُونَ
[Al-Mu'minun 23:117]
and His saying, Mighty and Majestic:
That is Allah, your Lord; to Him belongs sovereignty. And those whom you invoke other than Him do not possess [as much as] the membrane of a date seed. (14) If you invoke them, they do not hear your supplication; and if they heard, they would not respond to you. And on the Day of Resurrection they will deny your association. And none can inform you like [one] Acquainted [with all matters].ذَلِكُمُ اللَّهُ رَبُّكُمْ لَهُ الْمُلْكُ وَالَّذِينَ تَدْعُونَ مِنْ دُونِهِ مَا يَمْلِكُونَ مِنْ قِطْمِيرٍ (13) إِنْ تَدْعُوهُمْ لاَ يَسْمَعُوا دُعَاءَكُمْ وَلَوْ سَمِعُوا مَا اسْتَجَابُوا لَكُمْ وَيَوْمَ الْقِيَامَةِ يَكْفُرُونَ بِشِرْكِكُمْ وَلاَ يُنَبِّئُكَ مِثْلُ خَبِيرٍ

. Third: It is not permissible to hold a celebration for the Mawlid of the Messenger of Allah (peace and blessings be upon him) or anyone else from
among the people, nor to travel to attend it. His Eminence the Shaykh 'Abd al-'Aziz ibn 'Abd Allah ibn Baz has previously written extensively on the subject that it is a bid'ah (religious innovation) that the Messenger of Allah (peace and blessings be upon him) did not do, nor did his Companions (may Allah be pleased with them), nor did any other scholars in the blessed centuries, and all good lies in following them. And success is from Allah. And may Allah send prayers and blessings upon our Prophet Muhammad, his family, and his Companions.
